These Terms of Use ("Terms") govern your purchase and use of the Estate Sale Business System offered by Kingdom Creatives LLC ("Company," "we," "us") through estatesalebiz.com. By purchasing or using our product, you agree to these Terms. Please read them carefully before completing your purchase.
The Estate Sale Business System is a digital business toolkit that includes:
Delivery timeline: Your website will be configured and live within 48 hours of receiving your completed intake form. Document templates will be emailed within 24 hours of purchase. Delays beyond our control (e.g., you have not submitted your intake information) do not constitute a failure to deliver.
All purchases are processed securely through Stripe. By completing a purchase, you authorize us to charge the stated amount to your payment method.
Setup fee: Refundable in full within 24 hours of purchase, provided your intake form has not yet been submitted and no configuration work has begun. Once we begin building your site, the setup fee is non-refundable because we have committed time and resources to your specific configuration.
If we fail to deliver: If we do not deliver a live, functioning website within 7 days of receiving your completed intake form (barring information we are still waiting on from you), you are entitled to a full refund of your setup fee, no questions asked.
Hosting fees are non-refundable for the current billing period but will not be charged for future periods once you cancel.
Dissatisfaction with results: We do not offer refunds based on the performance of your estate sale business. The system provides tools and training — results depend on your effort, local market conditions, and other factors outside our control.
We offer a best-effort market territory policy. When you purchase, we will not knowingly sell the same system to another buyer in the same city or metropolitan area during your active subscription.
Important: This territory policy is a business practice, not a legally enforceable exclusivity guarantee. We cannot prevent others from independently starting estate sale businesses or building their own websites in your area. The territory policy applies only to our direct sales of this specific system.
If a territory conflict is discovered after your purchase (meaning another buyer purchased before you for the same area), you will receive a full refund of your setup fee within 5 business days.
The document templates included with your purchase (including but not limited to the client contract and consignment agreement) are provided as starting points for your own use, not as legal advice.
The training center content is provided for educational purposes based on general industry knowledge and our experience. It does not constitute professional business, legal, financial, or tax advice. Business results vary. We make no guarantees regarding income, client acquisition timelines, or the success of your estate sale business.
Upon purchase, you receive a license to use the website, dashboard, and training content for your own single estate sale business. You may not:
The underlying technology, design, and training content remain the intellectual property of Kingdom Creatives LLC. Your business name, logo, and client data are entirely yours.
We use industry-standard hosting infrastructure (Vercel and Supabase) and make reasonable efforts to maintain uptime. However, we do not guarantee 100% uptime. Planned maintenance, third-party outages, or circumstances beyond our control may temporarily affect your site's availability. We are not liable for lost business resulting from downtime.
To the maximum extent permitted by applicable law, Kingdom Creatives LLC's total liability to you for any claims arising from these Terms or your use of the system shall not exceed the total amount you paid for your current subscription period.
We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost clients, or business interruption.
You agree to indemnify and hold harmless Kingdom Creatives LLC, its owners, and employees from any claims, losses, damages, or expenses (including legal fees) arising from your use of the system, your estate sale business operations, or your violation of these Terms.
You agree to use the system only for lawful purposes. You may not use the website or dashboard to advertise fraudulent sales, misrepresent items, or engage in any deceptive business practices. We reserve the right to terminate your account without refund if you violate this provision.
These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Canyon County, Idaho, or through binding arbitration if both parties agree.
We reserve the right to update these Terms at any time. We will notify active customers of material changes by email at least 14 days before they take effect. Continued use of the system after the effective date constitutes acceptance of the updated Terms.
